The legal system when buying a house in Spain is a little different to that in the U.K. and can be somewhat daunting however so long as you follow a few simple guidelines the process shouldn’t be too difficult for you.

ALWAYS use a professional Estate Agent – one who is sufficiently experienced to advise you on the basics of the property buying system and who can liaise and communicate between all parties and who can converse on your behalf

ALWAYS use a suitably qualified Solicitor (Abogado) and we advise you employ one who is bi-lingual

When you have decided on the property you wish to purchase and a offer has been accepted a holding deposit of 2000 euros is paid to the Vendor via the Estate Agent. This deposit acts as a confirmation of the agreement between the parties and facilitates the removal of the property from the market – this enables sufficient time for the usual checks and searches to be carried out. Once the checks have been completed and any mortgage required obtained then the balance of the 10% deposit is paid (similar to the process in the U.K.) and a mutually convenient completion date is set.
